Abstract

Proses legitimasi dari pelaksanaan Undang-Undang Nomor 33 Tahun 2014 dilaksanakan sepenuhnya oleh Badan Penyelenggara Jaminan Produk Halal dengan prinsip satu pintu untuk memudahkan pelaku usaha menerbitkan sertifikat halal. Sehingga dalam rangka pembentukan BPJPH juga perlu dikaji terkait dengan tugas, fungsi dan kewenangan dari kementerian dan lembaga terkait dengan penyelenggaraan jaminan produk halal. Adapun permasalahan yang diangkat dalam penelitian ini adalah keefektifan Undang-Undang Cipta Kerja terhadap penyelenggaraan sertifikasi halal dan produk halal sebagai penguatan kewenangan lembaga BPJPH yang tercantum dalam Undang Undang Cipta Kerja. Berdasarkan permasalahan tersebut, peneliti tertarik mengkaji terkait SERTIFIKASI HALAL PASCA UU CIPTA KERJA No. 11 thn 2020. Dengan rumusan masalah (1) Bagaimana Sertifikasi Halal Pasca Undang-undang Cipta Kerja No 11 thn 2020? (2) Bagaimana Implementasi Sertifikasi Halal pasca Undang-undang Cipta Kerja No. 11 thn 2020? Penelitian ini termasuk dalam jenis penelitian kepustakaan atau library reserch yaitu penelitian dengan cara menganalisis dokumen, observasi, studi dokumentasi. Metode analisis eksisting pendekatan filosofis, sosiologis hukum, efektifitas hukum, yuridis dan legal drafting.
Adapun Hasil dari penelitian ini BPJPH dalam penyelenggaraan jaminan produk halal diberikan kewenangan untuk menerbitkan dan mencabut sertifikasi halal dan label halal pada produk. Kewenangan ini sebelumnya dilaksanakan oleh LPPOM-MUI. Yang berarti bahwa pemberlakuan UUJPH ini secara kelembagaan nantinya akan terjadi peralihan kewenangan dalam hal penerbitan sertifikasi halal dari LPPOM-MUI kepada BPJPH. BPJPH saat ini sudah dan telah dikoordinasikan ke Kemenag yang ditiap-tiap daerah, bahkan upaya sosialisasi ke masyarakat pun juga telah ada, namun terkendala dalam pengaturan dari masing- masing lembaga antara LPPOM-MUI dan BPJPH.

ABSTRACT:
The legitimacy process of the implementation of Law Number 33 of 2014 is fully implemented by the Halal Product Guarantee Agency with the one-door principle to make it easier for business actors to issue halal certificates. So that in the context of establishing BPJPH, it is also necessary to study related to the duties, functions and authorities of the ministries and institutions related to the implementation of halal product guarantees. The problem raised in this study is the effectiveness of the Job Creation Act on the implementation of halal certification and halal products as a strengthening of the authority of the BPJPH institution as stated in the Job Creation Act. Based on these problems, researchers are interested in studying the related Halal Certification After The Work Copyright Law. With the formulation of the problem (1) How is Halal Certification After the Job Creation Law No. 11 of 2020? (2) How is the implementation of Halal Certification after the Job Creation Law no. 11 yrs 2020? This research is included in the type of library research or library research, namely research by analyzing documents, observations, and documentation studies. Existing analytical methods approach philosophical, sociological law, legal effectiveness, juridical and legal drafting.
The results of this study BPJPH in the implementation of halal product guarantees are given the authority to issue and revoke halal certification and halal labels on products. This authority was previously exercised by LPPOM-MUI. Which means that the implementation of this UUJPH institutionally will result in a transfer of authority in terms of issuing halal certification from LPPOM-MUI to BPJPH. Currently, BPJPH has been coordinated with the Ministry of Religion in each region, and there have even been socialization efforts to the community, but there are problems with the arrangements of each institution between LPPOM-MUI and BPJPH.
