Abstract
The police have the authority to resolve criminal cases through investigations in accordance with Law of the Republic of Indonesia Number 2 of 2002 concerning the Indonesian National Police so that the police are obliged to resolve all criminal cases they receive based on the SOP by prioritizing the principle of equality before the law in accordance with the 1945 Constitution and prioritizing justice for the community. However, this becomes biased when the term no viral no justice appears due to protests from people who are disappointed with the performance of the police which allows the police to prioritize the resolution of viral cases over cases that are not viral. Therefore, this study aims to discuss the Prioritization of Law Enforcement of Viral Cases by the police and its implications for the principle of equality before the law and substantial justice.
This research is qualitative research and field research, using an empirical juridical approach. The data used are primary data obtained from interviews and secondary data obtained by documentation techniques. The data from the research were analyzed using various legal materials and theories, and analyzed descriptively to answer all the problems raised in this research.
The results showed that the element of virality in a criminal offense affects the speed of settlement of the case and case resolution based on viral criminal cases have implications for substantial justice and the principle of equality before the law. Substantial justice and equality before the law are not realized, because there are disparities/inequalities and discrimination/differences in law enforcement, to the detriment of victims whose cases do not go viral.
