Hak cipta dalam hukum Islam merupakan hak yang dilindungi sebagai bagian dari maqaṣid syariah, khususnya dalam menjaga harta (hifdhul mal). Pelanggaran hak cipta dianggap sebagai tindakan yang merusak dan termasuk dalam kategori ḍarūrāt yang harus dicegah. Salah satu fenomena pelanggaran hak cipta yang marak terjadi adalah penjualan e-book bajakan di platform marketplace. Shopee, sebagai salah satu platform marketplace terbesar, telah menerapkan kebijakan untuk mencegah dan menangani pelanggaran hak cipta. Namun, kenyataannya, e-book bajakan masih mudah ditemukan di platform tersebut. Berdasarkan fenomena ini, penelitian ini bertujuan untuk menganalisis upaya perlindungan hukum yang dilakukan marketplace Shopee dalam mencegah pelanggaran hak cipta, terutama terkait jual beli e-book bajakan, serta mengkaji upaya tersebut dari perspektif hukum ekonomi syariah.
Penelitian ini menggunakan metode kualitatif dengan pendekatan hukum yuridis empiris. Data diperoleh melalui wawancara, observasi, dan studi pustaka. Penelitian ini dianalisis menggunakan metode deskriptif kualitatif untuk memberikan gambaran menyeluruh terkait kebijakan dan pelaksanaannya.
Hasil penelitian menunjukkan bahwa marketplace Shopee telah melakukan berbagai upaya pencegahan pelanggaran hak cipta melalui kebijakan pendaftaran dan pengawasan. Namun, efektivitas upaya tersebut masih terbatas, sehingga e-book bajakan tetap beredar. Dari sudut pandang hukum ekonomi syariah, meskipun marketplace Shopee telah berusaha menjaga prinsip hifdhul mal, masih diperlukan perbaikan kebijakan yang lebih ketat dan komprehensif agar pelanggaran hak cipta dapat diminimalkan dan pemulihan hak cipta terlaksana dengan optimal.

ABSTRACT:
Copyright in Islamic law is a right that is protected as part of maqaṣid sharia, especially in safeguarding property (hifdhul mal). Copyright infringement is considered a destructive act and classified as ḍarūrāt that should be prevented. One widespread phenomenon of copyright infringement is the sale of pirated e-books on marketplace platforms. Shopee, as one of the largest marketplace platforms, has implemented policies to prevent and deal with copyright violations. However, in reality, pirated e-books are still easy to find on these platforms. Based on this phenomenon, this research aims to analyze the legal efforts taken by marketplace Shopee to prevent copyright infringement, especially regarding the rampant buying and selling of pirated e-books, as well as examining these efforts from the perspective of sharia economic law.
This research uses qualitative methods with an empirical juridical legal approach. Data was obtained through interviews, observation and literature study. This research was analyzed using qualitative descriptive methods to provide a comprehensive picture of policies and their implementation.
The research results show that marketplace Shopee has made various efforts to prevent copyright infringement through registration and monitoring policies. However, the effectiveness of these efforts is still limited, so pirated e-books remain in circulation. From the perspective of sharia economic law, even though marketplace Shopee has tried to maintain the principle of hifdhul mal, it still needs to improve stricter and more comprehensive policies so that copyright violations can be minimized and copyright restoration can be carried out optimally.
