Arabic is a chosen language by Allah as the language of His holy book. There is no doubt that Arabic have a function to clarify a meaning. While the way to obtain it is using i'rāb. I'rāb, as one branch of Arabic has a very important role in understanding the meaning of Qur’an and its interpretation, so, both have a very strong relationship.
Therefore, i'rāb has a relationship to Islamic sciences such as Tafsir, Qira’at, and Fiqh. In the Tafsir and Qira’at, we find that Mufassir have placed i'rāb as the basis for understanding the meaning of Qur’an and revealed the secrets behind the revealed Qur'anic sentences. In fiqh, there are numerous laws of Fiqh which are still debated by scholars due to the differences in i'rāb.
This study examined the effect of i'rāb differences on istinbath (excavation) of Fiqh laws from the verses of Qur’an. It is known that the differences in i'rāb are based on the meaning contained in the Nahwu experts thought. If they have different opinions in determining a topic in the sentence contained in the verses of Qur’an, absolutely these differences can affect our understanding and we can be sure the generated meaning from each opinion will be different from the others.
In this case, the researcher discussed the differences in the verses of law in which sometimes affect determined Fiqh laws by the experts, as well as some of the factors behind the differences in determining Fiqh law also related to i'rāb differences itself. Further, the researcher discussed the factors that make the scholars have differences in determining the verses of Qur’an
The researcher selected some of legal verses, then examined the verses in detail. Furthermore, the researcher explained the opinion differences of Nahwu experts regarding i'rāb of the verses and emphasized that i'rāb differences can affect the istinbath (excavation) of Fiqh law. In addition, the researcher also discussed the opinions of great scholars by referring to the books related to the legal verses interpretation.
