Abstract

Penelitian ini menggunakan pendekatan kualitatif, dengan metode pengambilan data menggunakan study literature dan wawancara. Menganalisis praktek peer to peer lending syariah di lapangan dengan dasar teori yang diperoleh dari studi literature dan pendapat para ahli ekonomi syariah. Penelitian ini bertujuan untuk mengetahui bagaimana praktek peer to peer lending syariah di lapangan dan prespektif para ahli ekonomi syariah mengenai layanan tersebut.
Subjek penelitian ini PT. Alami Fintek Sharia, yang merupakan salah satu fintech syariah yang terdaftar di OJK. Dengan objek penelitian mekanisme dan layanan peer to peer lending. Penelitian ini menggunakan teknik wawancara, dengan mewawancarai pegawai ALAMI, penerima pembiayaan, dan ahli ekonomi syariah (Prof. Ahmad Rofiq, M.Ag, Prof. Muchlis, M.Si, Dr. Nur Fatoni, M.Ag dan Dr. Ali Murtadho, M.Ag).
Peer to peer lending bertujuan untuk memudahkan para pelaku ekonomi yang membutuhkan dana, namun memiliki keterbatasan dalam melakukan pembiayaan di bank (unbankable). Perusahaan peer to peer lending syariah yang terdaftar di OJK per tanggal 20 Januari 2023 berjumlah tujuh perusahaan. dari ke tujuh perusahaan tersebut masih banyak perusahaan yang belum menaati peraturan OJK mengenai publikasi laporan keuangan. Dan masih ada beberapa perusahaan yang belum secara maksimal menerapkan prinsip – prinsip syariah.
Pada PT. Alami Fintek Sharia masih menerapkan biaya layanan, selain biaya ujroh, hal tersebut tidak dibenarkan dalam ekonomi syariah, karena dianggap layanan tersebut sebagai margin yang didapat jadi sebaiknya tidak dibebankan lagi dalam biaya layanan tersebut.

ABSTRACT:
This research uses a qualitative approach, with data collection methods using literature study and interviews. Analyzing sharia peer to peer lending practices in the field based on theory obtained from literature studies and the opinions of sharia economic experts. This research aims to find out how sharia peer to peer lending practices in the field and the perspectives of sharia economic experts regarding these services.
The subject of this research is PT. Experience Fintek Sharia, which is one of the sharia fintechs registered with the OJK. With the research object of peer to peer lending mechanisms and services. This research used interview techniques, by interviewing ALAMI employees, financing recipients, and sharia economic experts (Prof. Ahmad Rofiq, M.Ag, Prof. Muchlis, M.Si, Dr. Nur Fatoni, M.Ag, and Dr. Ali Murtadho, M.Ag).
Peer to peer lending aims to make it easier for economic actors who need funds, but have limitations in financing at banks (unbankable). Sharia peer to peer lending companies registered with the OJK as of January 20 2023 numbered seven companies. Of the seven companies, there are still many companies that have not complied with OJK regulations regarding the publication of financial reports. And there are still several companies that have not optimally implemented sharia principles.
At PT. Alami Fintek Sharia still applies service fees, apart from ujroh fees, this is not justified in sharia economics, because the service is considered as a margin obtained so it is better not to charge it again in the service fee.
