Abstract
In Islam, marriage aims to form a sakinah, mawaddah and warahmah family, but divorce and death can affect the division of joint assets. Even though Marriage Law no. 1 of 1974 and the Compilation of Islamic Law regulate the fair distribution of assets, differences often arise in practice, especially when career women contribute assets to the family. Decision Number 78 K/Ag/2021 provides different proportions of assets (30% for ex-husbands and 70% for ex-wives), this is different from the half-half distribution provisions in Article 97 KHI. This research analyzes the judge's considerations in the decision and evaluates the application of Islamic law regarding the distribution of assets for career women. This research is normative legal research using qualitative descriptive analysis, adopting a case study approach to the Republic of Indonesia Supreme Court Decision No. 78 K/Ag/2021 concerning the distribution of career women's assets. The research results show that the judge's considerations in Decision Number 78 K/Ag/2021 emphasize the importance of considering the contribution of each partner in the household in dividing joint assets. The principle of distributive justice is the basis, considering financial and non-financial roles and contributions to reach the fairest possible decisions. Based on the view of Islamic law, the division of joint assets can be adjusted to the circumstances of each case, depending on the fulfillment of the obligations and contributions of the husband and wife in the household. The Supreme Court's decision shows a flexible understanding of the concept of Islamic law in facing the social and economic realities of modern times.
